Eoin is a partner in the Litigation and Regulation Department.
His focus is on regulatory, public administrative and commercial litigation.
Eoin has extensive experience in public administrative law, European law and statutory interpretation. He advises government bodies on their regulatory responsibilities and the conduct of investigations, and litigation. Eoin has acted in regulatory environments in the Financial, Energy and Telecoms sectors.
Eoin has also acted in a number of significant disputes before the Commercial Court including breach of contract/breach of warranty, shareholder oppression and landlord and tenant disputes.
Eoin provides regular training to clients on commercial and regulatory law issues and lectures in the Law Society.
Eoin is ranked as by Legal 500 as a Next Generation Partner in White Collar Crime and Dispute Resolution.
Recent Experience
- Acting for a Regulator defending two Judicial Reviews regarding the implementation of an EU Regulation and in particular the decision and attendant reasons regarding its implementation. The case was ultimately heard by the Supreme Court (by way of leapfrog appeal) which was heard by a 7 Judge panel. A preliminary reference has now been made to the ECJ regarding, inter alia, the role and responsibilities of a regulator in implementing EU Regulations and the rights of individuals (including body corporates) to a remedy in a national Court.
- Acting for an administrative body in a number of tests cases regarding the constitutionality of primary legislation and the implementation of secondary legislation. Successful on all counts before a 7 judge Supreme Court Panel.
- Acting for a Regulator in enforcement actions including prosecutions and fixed penalty notices
- Advising a number of Regulatory and statutory bodies on the exercise of their functions, statutory interpretation and strategic advice.
- Acting in a significant dispute (over €100m) regarding the payment of an earn out contribution under a Share Purchase Agreement. On agreement of the parties the matter was dealt with by way of alternative dispute resolution which avoided any publicity.
- Acting in a number of disputes in the Courts and in Arbitration for shareholders in shareholder oppression actions
- Acting for landlords and tenants in commercial court disputes including contractual obligations, breach of covenants, termination provisions.
- Appointed as an Independent Solicitor by the High Court on foot of an Anton Pillar Order
- Appointed as an Independent Inspector by ministerial seal to carry out an investigation and draft a reasoned report for a statutory body
