Jennifer O’Neill is a Consultant in the Byrne Wallace Shields LLP Employment Law Team.

Jennifer is an experienced employment law practitioner with considerable expertise advising clients on general employment law compliance issues. Jennifer provides both domestic and international clients with ongoing employment law support to include drafting and reviewing contracts and policies, advising on arrangements with independent contractors, advising on working time, leave arrangements, terminations, disciplinary and grievance procedures, compromise agreements and redundancies.

In particular, Jennifer’s experience includes advising and assisting with employment issues arising on the acquisition or sale of a business or corporate entity. This includes conducting due diligence reviews and risk analysis exercises and negotiating warranty and indemnity protection in asset and share purchase agreements. Jennifer regularly advises clients on the implications of the transfer of undertakings regulations, whether on the outsourcing of services or the lease or sale of a business and assists employers with the related consultation and employee benefit issues.

Experience

  • Advising on a number of collective redundancy programmes for national and international clients which involved guiding the client through the process from initial planning and announcement stage up to the termination date.
  • Providing a diverse portfolio of national and international employers with advices on the development and updating of employment policies and practices, including general and specific compliance and HR audit issues.
  • Advising clients in relation to rights and duties, including drafting and amending employment contracts, secondment arrangements, employee handbooks, and codes of conduct to take account of legislative, HR and IR practice developments impacting on the workplace.
  • Advising in relation to employment law compliance issues and general issues arising from the employment relationship such as the rules in relation to working time, leave arrangements, recruitment and equality issues.
  • Advising on arrangements with independent contractors and drafting such arrangements.
  • Advising in relation to employment permit and visa issues for senior executives.
  • Advising in relation to employment issues arising on the acquisition of shares or businesses, to include conducting due diligence; advising on the implications of TUPE and advising on warranty and indemnity protections.
  • Assisting with employment issues arising on a change of contractor whether as part of a tender process or otherwise.
  • Advising in relation to employment aspects of out-sourcing agreements.
  • Assisting with negotiations and settlements arising from senior management exits.

Qualifications

  • Diploma in Employment Law, University College Dublin, 2002
  • Admitted as a Solicitor in Ireland, Law Society of Ireland, 1999
  • B.A. in Law and Accounting, University of Limerick, 1995
