Building Control (Amendment) Regulations 2014

These regulations were published in January of this year and come into operation on the 1 March 2014. They revoke and replace the Building Control (Amendment) Regulations 2013 ("2013 Regulations") which were also due to come into operation on the 1 March 2014. 

Whilst the 2014 Regulations retain the majority of changes made by the 2013 Regulations the wording of the statutory certificates put forward in the 2013 Regulations has been amended which should address some of the concerns that were expressed by construction professionals responsible for giving the certificates. The 2014 Regulations also now recognise an online Building Control Management System as the preferred means of building control administration. 

By way of reminder the main changes introduced by the 2013 Regulations which are incorporated in the 2014 Regulations are as follows:  

  1. Revised form of Commencement Notice and 7 Day Notice. The Regulations stipulate the range of documentation, including plans and specifications, which must be lodged with each such notice.
  2. New certificates including, a Certificate of Compliance (Design), Notice of Assignment of Person to Inspect and Certify works (Assigned Certifier), Certification of Compliance (Undertaking by Assigned Certifier), Notice of Assignment of Builder and a Certificate of Compliance (Undertaking by Builder).
  3. New Certificates of Compliance on Completion and Statutory Register. It is important to note the completion certificate must be included on the statutory register before the works or building to which it relates can be opened, occupied or used.
