Experience

  • Acting for one of the main insurers in the defence of Commercial Court proceedings (valued at circa USD 2 billion) brought by various global aircraft lessors concerning aircraft remaining in Russia following the invasion of Ukraine and the subsequent imposition of sanctions.  
  • Providing coverage advice and acting in related disputes (including a major arbitration) concerning business interruption insurance policies in the context of the COVID-19 pandemic.
  • Advising the SMDF and various other insurers in hundreds of professional indemnity claims against solicitors.
  • Acting for the product liability insurers of an Irish quarry operator in the defence of hundreds of High Court proceedings concerning defects in residential properties. These proceedings, known as the ‘pyrite litigation’, stemmed from the alleged supply of defective materials for use in the construction of hundreds of residential properties.  
  • Acting for various London market insurers in the defence of High Court proceedings against construction professionals including architects, engineers, surveyors and assigned certifiers.
  • Advising FBD Insurance Group in relation to High Court proceedings centred on the refusal of Royal London Mutual Insurance to pay out on a life assurance policy for reasons of non-disclosure of material medical facts during the policy application process.
  • Representing directors of regulated financial services providers on instructions from D&O insurers in Central Bank of Ireland investigations and inquiries.
  • Advising D&O insurers in the defence of proceedings in which the claimants allege breaches of the Data Protection Acts 1988 to 2018 and the EU General Data Protection Regulation in relation to the security and processing of their personal data and/or sensitive data. 
  • Advising cyber insurers on policy coverage.
